**This Seasonal RV Site Lease Agreement (the "Agreement") is entered into on today's date, ("Effective Date") by and between: **
**{{guest_firstname}}{{guest_lastname}}, hereinafter referred to as the "Lessee," and**
**Big Elbow Lake Lodge & Campground, LLP, hereinafter referred to as the "Lessor."**
**Collectively referred to as the "Parties."**
**1. RV Site Details**
1.1 **Location:** The RV site is located at 40419 Elbow Lake Store Rd, Waubun, MN 56589.
1.2 **Season:** This seasonal lease shall be in effect from May 1st, 2024, to October 1st, 2024.
**2. Lease Term**
2.1 **Rent Payment:** The Lessee agrees to pay the Lessor a total rent of $3,000 for the entire lease term, payable as follows:
- An initial payment of $1,000 is due upon the execution of this Agreement and the remaining balance of $2,000 shall be paid in 2 equal installments of $1,000 each as follows *$1,000 on January 1st, 2024, and $1,000 on March 1st, 2024. There is no penalty for paying in full prior to the due dates.
2.2 **Late Fee:** If any monthly installment is not received by the Lessor within 5 business days after the due date, a late fee of $100 shall be assessed.
2.3 **If total rent due ($3,000) is not paid in full before March 15th, 2024 all rent paid to date is forfeit to the lessor and the unit will be placed on the market and rented to the next party on the waiting list.
**3. Use and Occupancy**
3.1 **Authorized Use:** The Lessee is permitted to use the RV site exclusively for the purpose of parking and living in their recreational vehicle (RV) during the lease term. The Lessee may also use any common areas or facilities provided by the Lessor as outlined in any separate rules and regulations.
3.2 **Guests:** The Lessee may have guests visit the RV site but must ensure that guests comply with all applicable rules and regulations set by the Lessor. All overnight guests must be registered at the office. We do not charge for additional guests but need them registered in the unlikely event of a natural disaster.
3.3 **Prohibited Activities:** The Lessee agrees not to engage in any illegal activities or activities that may disturb the peace and quiet of the RV site or neighboring sites. This includes, but is not limited to, excessive noise, littering, and any activity that violates local laws or ordinances.
**4. Maintenance and Repairs**
4.1 **Lessee Responsibilities:** The Lessee is responsible for maintaining their RV in good condition and for any repairs or maintenance required to keep it in working order. The Lessee shall also be responsible for keeping their RV site clean, mowed, and free from debris. The lessee is also responsible for any electrical usage to their site, including any off-season usage.
4.2 **Lessor Responsibilities:** The Lessor shall maintain the common areas and facilities in good condition and repair.
**5. Rules and Regulations**
5.1 **Compliance:** The Lessee agrees to comply with all rules and regulations set forth by the Lessor, which are attached hereto as Exhibit A and incorporated by reference.
**6. Termination**
6.1 **Early Termination:** If either party wishes to terminate this Agreement before the end of the lease term, they must provide 30 days written notice to the other party. No refunds will be allowed for early termination.
6.2 **Default:** In the event of a material breach of this Agreement by either party, the non-breaching party may terminate this Agreement immediately upon written notice.
**7. Security Deposit**
7.1 **Deposit Amount:** The Lessee will pay an electrical security deposit of $100 to the Lessor by May 1st, 2024. This deposit shall be held by the Lessor as security for the Lessee's obligations under this Agreement.
7.2 **Return of Deposit:** The security deposit shall be returned to the Lessee within 30 days after the end of the lease term, less any deductions for unpaid rent, late fees, damages, or cleaning expenses.
**8. Miscellaneous**
8.1 **Governing Law:** This Agreement shall be governed by and construed in accordance with the laws of the state of Minnesota.
8.2 **Entire Agreement:** This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements or understandings, whether oral or written.
IN WITNESS WHEREOF, the Parties hereto have executed this Seasonal RV Site Lease Agreement as of the Effective Date.

**EXHIBIT A - Rules and Regulations**

Rules
Camping can be fun if everyone is considerate of others. Any person found violating any of the rules shall be subject to immediate removal from Big Elbow Lake Lodge and Campground with no refund.
Some of our rules include:
Quiet time- 10 p.m. to 7 a.m.
Picnic, dock and beach areas close at 10 p.m. Please respect these closing times.
No violent, immoral, abusive, loud or obscene conduct will be allowed.
Cutting trees or branches is not allowed without permission. Doing so, could result in a fee being charged. For your convenience firewood is available for purchase at the lodge.
Dispose of garbage into containers provided.
Swimming is only at one’s own risk. Diving and jumping from the dock area is strictly prohibited. NO hanging on buoys or ropes or you will be asked to leave swimming area. Buoys and ropes are in place for the swimming safety of our youngest guests. Please accompany your children 12 and under to the beach area.
Campfires are permitted in designated fire rings only and must be under supervision at all times. Campfires may be banned under certain conditions and notices will be posted. Fire rings are for wood only. No garbage, diapers, cans, bottles,etc should be thrown or left in fire ring. Please leave your camping area tidy upon departure.
No non-registered visitors or non-registered vehicles shall be allowed in park or campsite after 10 p.m. Please use overflow parking and attach parking pass for all extra vehicles. No parking in ditches or other areas of the campground. We do not charge a fee for guests of our guests. We do ask that they are registered. We need a head count in the unlikely event of a natural disaster.
Please do not leave your children (age 12 and under) unattended.
Seasonal guests must register each season, sign a lease agreement and follow all park rules.
Pets
• Pets are allowed provided they are kept on a leash.
• Please ensure that your pets are fully vaccinated before your stay.
• Pets must be attended at all times.
• Campers who leave pets unattended and pets that bark excessively will be warned and it will be asked that you remove your pet from the campground. If barking persists; campers will be asked to leave with no refund.
• Pets are not allowed in camp store or in shower houses.
• Please remember to clean up after your pets.
• There will be a $150 pet deposit for camping cabins on the Wandering Ridge of which $50 is nonrefundable.
• Cabins will be inspected upon departure.
